These Terms of Service ("Terms") govern your use of the RIA Health Check website and compliance scanning service ("Service") operated by RIA Health Check ("we," "us," or "our"). By using the Service, you agree to these Terms.
RIA Health Check provides an AI-assisted compliance scanning service that reviews publicly accessible website content of SEC-registered investment advisers against regulatory requirements, including the SEC Marketing Rule (Rule 206(4)-1), Form ADV requirements, and related regulations.
The Service generates compliance risk scorecards and reports based on automated analysis of publicly available information.
Not legal or compliance advice. The Service is provided for informational and educational purposes only. Our reports and scorecards do not constitute legal, compliance, regulatory, or investment advice. Nothing in our reports should be interpreted as a finding of any violation of applicable laws or regulations.
Not a substitute for professional review. Our automated analysis is not a substitute for review by qualified compliance counsel, a Chief Compliance Officer, or other compliance professionals. We strongly recommend that all findings be reviewed by your firm's compliance team before taking action.
No professional relationship. Use of the Service or receipt of a report does not create a lawyer-client, adviser-client, or other professional advisory relationship between you and RIA Health Check.
Not affiliated with the SEC. RIA Health Check is not affiliated with, endorsed by, or sponsored by the U.S. Securities and Exchange Commission, FINRA, or any other regulatory body.

The Service, including our scanning methodology, report templates, website content, and branding, is our proprietary intellectual property. Reports generated for your firm are licensed to you for your internal use only.
While we strive for accuracy, our Service has inherent limitations:
We do not guarantee the completeness, accuracy, or reliability of any report or finding.
Compliance reports are delivered digitally as a completed, personalised analysis. Once the full report has been delivered to your inbox, refunds are not offered except in the following circumstances:
To request a refund, reply to your Stripe receipt or email info@riahealthcheck.com with your order reference and the reason for your request. Approved refunds are processed within 5 business days to the original payment method.
Refund requests submitted more than 30 days after delivery, or based on dissatisfaction with findings that are correctly supported by publicly available evidence, are generally not eligible.
To the maximum extent permitted by law, RIA Health Check shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from regulatory actions, compliance failures, or business decisions made based on our reports.
Our total liability for any claim arising from the Service shall not exceed the amount you paid for the specific report giving rise to the claim.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration.
